Pulzor Terms of Use and License (EULA)
1. Acceptance
By installing, accessing, or using Pulzor (iOS/watchOS), you accept these Terms of Use and License ("Terms"). If you do not accept, do not use the App and uninstall it.
If you use Pulzor on behalf of a company or other entity, you represent that you have the authority to bind it to these Terms.
2. Definitions
- "App / Pulzor": the Pulzor application and its updates.
- "User / you": the natural person or entity using the App.
- "Device": compatible Apple hardware on which the App runs.
- "Infrastructure": systems, services, websites, APIs, networks, or databases that you configure in the App.
- "Advanced Features": functionalities that may include automations, maintenance windows, webhooks, VPN, remote access, command execution, scheduled tasks, and auto-recovery (depending on version/plan).
- "Third Parties": providers outside the Owner, including Apple and services configured by the user.
3. License Grant (EULA)
We grant you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use Pulzor on Devices you control, solely in accordance with these Terms and applicable law.
4. Intellectual Property
Pulzor (code, design, UI, brand, text, icons, and other elements) belongs to the Owner or its licensors. You do not acquire ownership, only a right of use.
5. Restrictions
You may not, unless mandatorily permitted by law:
- decompile, disassemble, or reverse engineer;
- copy, modify, create derivative works, or redistribute;
- circumvent purchase/license validation or security measures;
- interfere with the operation of the App or attempt to disable limits/controls;
- use the App to infringe third-party rights.
6. Acceptable Use (AUP)
You agree to use Pulzor only on infrastructure over which you have right and authorization (by ownership, administration, or express consent of the owner).
It is prohibited to use Pulzor for:
- unauthorized access, intrusion, exploitation, or privilege escalation without authorization;
- brute force, malware, phishing, DoS/DDoS, hostile scanning, or criminal activities;
- illegal activities or activities that violate third-party rights;
- processing third-party personal data without a legal basis and without complying with applicable regulations.
We may restrict features or suspend use when there are reasonable indications of fraud, abuse, or security risk, within technical capabilities and in accordance with applicable law.
7. Advanced Features: Technical Nature and User Responsibility
Pulzor may include tools that allow executing actions with real effects on systems (for example, remote commands, automations, scheduled tasks, or recovery rules). You accept that:
- you decide what you configure and execute;
- actions may have real and irreversible effects (e.g., restarts, deletions, configuration changes, unavailability, or data loss);
- you are responsible for credentials, permissions, scope of automations, and the principle of least privilege;
- any template catalog, risk levels, or operating system detection is indicative and may fail;
- the App may offer confirmations, warnings, and security controls, but does not replace your technical judgment or adequate supervision.
8. User Security Obligations
As a condition of responsible use, you accept:
- use secure credentials and protect your Device (passcode, biometrics, encryption, Apple ID);
- avoid using accounts with elevated privileges when not necessary;
- maintain backups and a recovery plan;
- test commands and automations in test environments when possible;
- configure reasonable limits (cooldowns, maximum attempts, maintenance windows, etc.);
- periodically review integrations (webhooks), tokens, endpoints, and permissions.
9. Exports, Backups, and Recovery
Pulzor may allow exporting configurations or data in backup files and/or encrypted exports. If you use password protection or encryption:
- the User is responsible for safeguarding such files and their passwords;
- if the User loses the password or file, the information may be unrecoverable;
- the Owner assumes no liability for losses arising from inadequate custody, loss, or unauthorized access to such files.
10. Not Suitable for Critical Uses
Pulzor is not designed, certified, or intended to operate as a control system for environments where a failure could cause personal injury, life-threatening risks, serious environmental damage, or catastrophic consequences (for example, critical medical equipment, high-criticality industrial control, aeronautics, nuclear, or equivalent systems). If you wish to use it for such purposes, a separate written agreement with specific conditions would be required.
11. Monitoring, Alerts, and Technical Limitations
Monitoring depends on multiple external factors (connectivity, DNS, providers, iOS/watchOS policies, destination availability, third-party limits, etc.). Therefore:
- we do not guarantee 100% detection or absence of false positives/negatives;
- we do not guarantee response times or continuity;
- no SLA exists unless agreed in a separate written agreement.
Maintenance windows, alert suppression, and automation rules may reduce or eliminate notifications during their validity. The User is responsible for their configuration and scope.
12. Third Parties (Apple, Webhook Providers, External Services)
Some functionalities depend on Third Parties:
- purchases and subscriptions are managed by Apple;
- iCloud/CloudKit depends on Apple if the user activates it;
- webhooks and integrations depend on the configured provider;
- certain network or query services (e.g., DNS/DoH resolution, domain lookups) may depend on third parties.
We do not control Third Parties nor guarantee their availability. Your relationship with those services may be subject to their own terms and policies.
13. Availability, Support, and Service Changes
We may modify, update, suspend, or withdraw features for technical reasons, security, iOS/watchOS changes, Third Party dependencies, or to comply with regulatory requirements. In situations of security risk or abuse, we may apply immediate measures to mitigate damage.
Support is provided by the Owner, not Apple. Contact: ppa.rozlup@troppus
14. Termination
We may suspend or terminate your license if:
- you breach these Terms;
- there is a risk of security, fraud, or unlawful use;
- it is necessary to comply with the law or Apple requirements.
You may stop using Pulzor and uninstall it at any time.
15. Consumers and Businesses
If you use Pulzor as a consumer, you may have mandatory rights in your country that cannot be limited by contract. Nothing in these Terms is intended to exclude such rights.
If you use Pulzor as a business or professional, you accept that the allocation of risks, limitations, and obligations described in these Terms is an essential element of the contractual relationship.
16. Disclaimer of Warranties
To the maximum extent permitted by law, Pulzor is offered "as is" and "as available", without warranties of fitness for a particular purpose, absence of errors, or uninterrupted operation.
17. Limitation of Liability
To the maximum extent permitted by law:
- we shall not be liable for indirect or consequential damages (data loss, lost profits, business interruption, reputational damage, recovery costs, etc.);
- if liability is determined, the Owner's total aggregate liability for any claim related to Pulzor shall not exceed the amount actually paid by the User through Apple for Pulzor during the three (3) months immediately preceding the event giving rise to the claim.
- if the User has not made payments through Apple for Pulzor during said period, the limit shall be 0.
Nothing in these Terms limits liabilities that cannot be limited by law (for example, willful misconduct or mandatory consumer rights where applicable).
18. Indemnification (by the User)
To the maximum extent permitted by law, you agree to indemnify and hold harmless the Owner against third-party claims, damages, sanctions, and reasonable costs (including reasonable legal fees) arising from:
- your illegal, unauthorized, or Terms-violating use;
- your negligence in safeguarding credentials or configuring permissions;
- actions or automations executed by you through Advanced Features (including commands, scheduled tasks, recovery rules, VPN, or webhooks);
- your breach of applicable regulations in relation to your Infrastructure.
19. Legal Compliance and International Use
You agree to comply with applicable laws and regulations in your jurisdiction and in the jurisdiction where your Infrastructure is located. You shall not use the App for illegal, unauthorized, or third-party rights-infringing activities.
20. Minimum Age and Capacity
Pulzor is not intended for minors under 16 years of age.
By using the App, you represent that you are at least 16 years old and have sufficient capacity to accept these Terms. If you are between 16 and 17 years old, you represent that you have the necessary authorization from your parent or legal guardian when required by applicable law and that your use of Pulzor will be carried out in accordance with such authorization.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, such provision shall be interpreted to the minimum extent necessary to make it valid and the remainder shall remain in effect.
22. Entire Agreement
These Terms constitute the complete agreement between the User and the Owner regarding the use of the App and supersede any prior agreement or communication related to the App.
23. Notifications
Communications regarding material changes to these Terms may be made within the App, at https://pulzor.app, and/or by other reasonable means when required by law.
24. Language
These Terms may be made available in multiple languages. In case of discrepancy between versions, the Spanish version shall prevail, unless applicable law provides otherwise.
25. Governing Law and Jurisdiction
These Terms shall be governed by the law of Spain, without prejudice to mandatory rules and mandatory consumer rights applicable in the user's country of residence, unless a different mandatory rule of the consumer's place of residence applies.
For any dispute, the parties submit to the courts and tribunals of Málaga, unless a different mandatory rule applies.
26. Changes to Terms
We may update these Terms. If the change is material and the law requires notice or consent, we will do so by reasonable means (e.g., within the App). Continued use after the effective date implies acceptance, unless the law requires explicit acceptance.
